General Provisions

  1. The contract between PRISMA srl, hereinafter referred to as the seller, and the buyer will be concluded solely on the basis of these General Terms and Conditions for End Consumers or the General Terms and Conditions for Resellers, available for download at www.prismaitalia.net. All other general terms and conditions are not recognized and apply only if accepted in writing by the seller.
  2. A consumer is any natural person who enters into a legal act for a purpose that is neither commercial nor self-employment. Reseller means any natural or legal person or partnership with legal capacity who, at the time of entering into the contract, is acting in the exercise of his or her commercial or independent professional activity.
  3. The company operating the online store under the domain www.prismaitalia.net (hereinafter referred to as “online store”) is: PRISMA srl, Via Umbria 7, 65015 Montesilvano (PE) Italy, P.I. 01623830666, Tel. +39.085.9118703.
  4. Contact with the online store is possible by e-mail and telephone. Contact information can be found at www.prismaitalia.net.
  5. The General Terms and Conditions of Sale determine the rights and duties of buyers, as well as the rights and duties of the seller as the entity operating the online store.
  6. The General Terms and Conditions are available in Italian.
  7. Buyers agree to respect copyrights and rights arising from the registration of inventions, patents, trademarks, utility models and industrial designs.
  8. The owner of www.prismaitalia.net, PRISMA srl is committed to taking the necessary legal and organizational measures for the secure processing of buyers’ personal data.

Conclusion of the contract

  1. Subject of the Contract
    This contract concerns the sale of goods by PRISMA Srl to the buyer through the Internet platform prismaitalia.net.
  2. Purchasing Process
    The purchase can be made both with and without registration by the buyer. In the case of registration on prismaitalia.net, the buyer is required to provide their shipping data and other information necessary for the proper processing of the order. This data is stored by PRISMA srl. and can be modified by the buyer through their account. The buyer enters the requested information using the keyboard and mouse functions on the PRISMA Srl website. During registration, the buyer is required to create a password and must take responsibility for ensuring that the password does not fall into the hands of unauthorized third parties.
  3. Product Selection and Purchasing
    The buyer can select products from the catalog offered by PRISMA Srl and add them to the cart by clicking on the “Add to Cart” button. In the shopping cart, the buyer can view the list of selected products. By clicking on the “Proceed to Payment” button, the buyer makes a binding declaration to purchase the products in the shopping cart. Before confirming the order, the buyer has the opportunity to view and edit the selected products using keyboard and mouse functions.
  4. Order Confirmation
    PRISMA Srl may accept the buyer’s order by sending an order confirmation by e-mail within 2 working days. The contract will be considered concluded only when PRISMA Srl sends such confirmation. In the event that the order is not accepted within the above deadline, the contract will not be considered concluded.
  5. Right of Revocation
    Any purchaser who is a consumer has the right to revoke their request and return the goods in accordance with the specific instructions for revocation provided at the time of ordering on the prismaitalia.net website.
  6. Language of the Contract
    The description of the items in the contract is written in Italian. The contract can be made in Italian or English. Buyers can use the print and save functions offered by their browsers. PRISMA Srl saves the text of the contract and sends the order data to the buyer by e-mail. The buyer can look up previous orders in his or her account.

Product availability

  1. There is no binding commitment from the seller. In the event that the product selected by the buyer is not available at the time of the order, the seller will immediately notify the buyer of this situation through the order confirmation. In the event that the product is not permanently available, the buyer will be informed of this circumstance and the seller will not issue a statement of acceptance, so the contract will not be concluded.
  2. In the event that the product specified by the customer in the order is temporarily unavailable, the seller will also promptly notify this situation in the order confirmation. If the delay in delivery exceeds two weeks, the buyer will have the right to withdraw from the contract. In such a case, the seller will also have the right to withdraw from the contract. In the case of withdrawal, the seller will immediately refund any payments already made by the buyer.

Reservation of property

  1. Ownership of the goods remains with the seller until the purchase price, including VAT and shipping costs, has been paid in full.

Payment and shipping methods

  1. Choice of payment and delivery method
    The seller offers several payment options to choose from for each order. Where advance payment has been agreed upon, the ordered goods will be shipped only after payment has been received in the seller’s bank account.
  2. Price and taxes
    The price of the proposed goods includes value-added tax (VAT) at the current rate. The amount of shipping charges is specified in the item description.
  3. Delivery hours and days
    Goods are shipped exclusively during business days Monday through Friday. Please keep in mind that couriers usually deliver from 8 a.m. to 4 p.m. on weekdays. Therefore, the buyer is asked to consider these times when planning delivery.
  4. Shipping and return charges
    Shipping charges are indicated in the item description and are the responsibility of the buyer. In case the buyer exercises the right of withdrawal, the shipping costs will be refunded. However, the buyer will have to bear the direct costs of return.
  5. Delivery time
    The estimated delivery time is a maximum of 7 days. Counting of the delivery period begins on the day after prepayment, from the date the payment order is issued by the sender bank. In the case of other payment methods, the delivery period begins on the day after the contract is concluded. The delivery period ends at the end of the specified period. If the last day of the delivery period falls on a Saturday, Sunday, or a state-recognized holiday at the place of delivery, the next business day will replace that day.

Rights and return procedures

  1. Right of withdrawal
    The buyer has the right to cancel the contract within 14 days without giving any reason. The withdrawal period lasts 14 days from the day the buyer or a third party designated by the buyer, other than the courier, takes possession of the goods. If the buyer has ordered multiple items that are shipped separately, the withdrawal period begins on the day the buyer or a third party designated by the buyer, other than the courier, takes possession of the last item. To exercise the right of withdrawal, the buyer must inform the seller by a clear statement (e.g., letter or e-mail sent by mail) of his or her decision to revoke the contract. You can use the attached withdrawal form, although it is not mandatory. In order to comply with the withdrawal period, it is sufficient for the notification of the exercise of the right of withdrawal to be sent before the expiration of this period.
  2. Consequences of withdrawal
    If the buyer revokes the contract, the seller is obligated to refund all payments received from the buyer, including delivery costs (except for additional costs resulting from choosing a type of delivery other than the cheapest standard delivery offered by the seller), immediately and in any case within 14 days from the day the seller receives the notice of withdrawal. Refunds will be made using the same payment method used by the buyer for the original transaction, unless otherwise agreed. No additional costs will be charged to the buyer for the refund. The seller may withhold the refund until the seller receives the goods or until the buyer provides proof of return, whichever comes first. The buyer shall return or deliver the goods to the seller without undue delay and in any case not later than 14 days from the day on which he has notified the seller of the revocation of the contract. The deadline is considered to be met if the goods are shipped before the 14-day deadline. The buyer is responsible for the direct costs of returning the goods. The purchaser will be responsible for the decrease in the value of the goods only if this decrease is the result of manipulation of the goods that is not necessary to verify their nature, characteristics and operation.
  3. Exceptions to the right of withdrawal
    The right of withdrawal does not apply to contracts for the supply of customized or custom-made goods, perishable goods or goods with a short expiration date, alcoholic beverages with an agreed price but available for delivery later than 30 days after the conclusion of the contract, newspapers, periodicals or magazines (except for subscriptions), sealed goods that cannot be returned for health protection or hygiene reasons if the seal has been removed after delivery, goods inextricably mixed with other goods after delivery, and audio, video or computer software recordings with the seal broken after delivery.
  4. End of withdrawal policy
    This is the withdrawal policy applicable to transactions made with the seller.

Pricing and Payment

Prices

  1. Product prices on the website (unless the customer is logged in with their customer account) are in euros and include taxes and fees.
  2. Product price before adding to cart does not include shipping and other costs. Shipping charges and any taxes will be added to the total amount of goods ordered at a later stage. The customer will be informed of any additional costs (e.g., packaging and shipping) before placing the order.
  3. The final price, binding on the store and the customer, will be the total amount shown on the website before the customer places the order. The final price includes all costs related to the fulfillment of the contract.
  4. Information about the total value of the order (including shipping and other charges) will be displayed before sending the order for payment and confirmed in the email sent later to the email address specified by the customer.

Payment

  1. When ordering, the customer selects the payment method.
  2. The company that provides online payment services and handles payments in the online store is Stripe Inc.
  3. If it is necessary to refund the funds to the customer using the payment card, the seller can transfer them to a bank account associated with the card.
  4. If the customer makes payment by payment card, the order will be processed as soon as payment authorization is obtained.
  5. The customer agrees to provide the correct data for VAT invoicing.

The customer agrees that invoices (including any corrections) may be issued and delivered electronically. Consenting to the use of electronic invoices is equivalent to giving up the paper version. Customers can revoke their consent to the use of electronic invoices by contacting the vendor’s customer service department.

Shipping

  1. Products ordered will be delivered or made available for pickup using the shipping method selected by the customer when ordering.
  2. The customer has the option of arranging the pickup or transportation themselves, however, dates, costs, and responsibilities must be agreed upon individually with the seller.
  3. The seller specifies the delivery date. If the agreed date is exceeded, the customer has the right to give the seller an alternative date. If the goods are not delivered by the specified date, the customer may withdraw from the contract.
  4. Until the customer, as a consumer, receives the goods, the seller is responsible for any loss or damage. Unless the customer chooses a delivery method other than the one suggested by the store.
  5. Goods are delivered during working days (Monday to Friday). There are no deliveries on weekends and holidays.
  6. Upon receipt, the customer is required to check the goods immediately. In case of damage, the customer must fill out a damage report in the presence of the courier. Completion of the report is not a prerequisite for filing a claim or withdrawing from the contract.
  7. If the packaging is damaged, the customer is not obliged to accept the delivery and should contact the seller as soon as possible. The seller, as a supplier, is liable to the consumer customer in accordance with the warranties set forth in Chapter 10 of the Terms and Conditions of Sale in the event that the product has a material defect or lack of conformity.
  8. If the customer is a consumer, the shipping risk is borne by the seller.

Right of withdrawal

This chapter applies only to customers who are consumers and entrepreneurs with consumer rights (as defined in Chapter 2, Section 7 of these Terms and Conditions of Sale).

  1. Subject to the provisions of Chapter I, paragraph 7 of these Terms and Conditions of Sale, the customer as a consumer may exercise the right to withdraw from the contract within 14 days after delivery of the product without having to specify the reasons.   2. In the event that the customer chooses a shipping method other than that offered by the seller, the seller is not obligated to reimburse the consumer for any additional costs incurred.
  3. In case of withdrawal from the distance contract, the contract will be considered cancelled. Parties must return what is claimed in unaltered condition. Goods must be returned without delay and within 14 days at the latest. The goods must be returned to the following address: PRISMA srl, Piazza Duca D’Aosta, 31 65121 Pescara (PE) Italy.
  4. The direct costs of returning the delivered goods in connection with the exercise of these rights shall be borne by the customer, unless the seller agrees to bear such costs or unless the customer has been informed by the seller of his or her right of withdrawal.
  5. In case of withdrawal from the contract, the online store will refund the customer the amount paid within about 14 days after receiving the notice of withdrawal. The refund will be made through the current account indicated by the customer or through the payment method originally used for the purchase. The store will issue a written refund confirmation.
  6. The customer is required to return the goods within 14 days of the declaration of withdrawal unless the seller proposes an alternative solution. The deadline will be considered met if the goods are returned by the deadline.
  7. A sample withdrawal statement is available on the store’s website or will be emailed in the order confirmation.
  8. There is no right of withdrawal from the distance contract in the following cases:
    • Services that have been specifically customized by the consumer in the order placed;
    • Services involving perishable or short shelf life goods;
    • Services involving sealed packaged goods that cannot be returned once opened, for health protection reasons, if the customer has opened the package;
    • Services involving goods that, after delivery, are inseparable from other goods because of their characteristics;
    • Services involving adapted goods or custom-made products based on individual customer needs.

Commercial warranty

This chapter applies to customers, both commercial enterprises and consumers.

  1. Products offered in the store are covered by warranty. The conditions and duration of the warranty are stated in the Terms and Conditions of Sale, warranty conditions, product description, or on a warranty card.
  2. The commercial warranty period is 2 years. However, some products may have a different and longer warranty period, such as 3, 5 or 10 years. This is specified specifically for the products concerned.
  3. To make a claim under the warranty, please contact customer service using the claim form available in the returns, replacements and complaints section of the website.

Statutory warranty rights

Warranty rights are governed by current legal regulations.

Processing of personal data

The manner in which the personal data of customers (individuals) is processed is described in the “Privacy Policy,” which is attached to these Terms and Conditions or available on the website.

Additional Provisions

Technical conditions for using the shop:

  1. In order to use the store, the customer must possess:
    • A device for transferring computer data.
    • Internet access.
    • An e-mail address.
    • Software for opening PDF files (such as Adobe Acrobat Reader).
  2. Customers are informed that disabling cookies may affect some functions of the store. After accessing the store website, the customer will be asked to accept the cookie policy.
  3. All detailed information about cookies is available in the www.prismaitalia.net cookie policy and is an integral part of these Store Terms of Use.
  4. To open an online account, customers must register via the form by providing login information, e-mail address and password.
  5. The password for the store consists of letters, numbers and/or special characters. It is unique for each user and can be changed on the website by providing the e-mail address and new password. It is recommended to change the password regularly.
  6. Creating a “customer account” is free of charge.
  7. The customer agrees to provide correct data.
  8. By accepting the general terms and conditions, the customer declares the following:
    • I voluntarily registered to take advantage of the store’s services.
    • The data provided in the form are true.
  9. The customer may not give the password of the online store account to a third party.
  10. The registered customer can:
    • View the status and history of your orders.
    • Benefit from individual discounts and special offers.
    • Receive information on participation in promotions and contests.
    • Place product orders.
    • Update your personal information.
    • Review orders placed.
    • Change the password.
  11. After registration, the customer will be sent a confirmation link to the e-mail address provided.
  12. The client, after registration, will be able to access the system.

Order processing:

  1. The store is open 24/7, and the customer can place an order at any time.
  2. The seller checks the order placed by the customer. After positive verification, the online store confirms the order to the customer by e-mail. When the customer receives such confirmation, a distance contract is concluded between the parties.
  3. The confirmation message contains the proposed contents of the sales contract, specifically: Order number and date, product details, price, payment method, details of the parties involved, place, method and cost of delivery.
  4. If the proposed content of the purchase agreement does not match the order placed by the customer, the customer should immediately inform the online store by sending an e-mail to info@prismaitalia.net indicating the discrepancies found. The online store will send the customer the correct content of the contract.
  5. A warranty card from the manufacturer, importer, or distributor will be attached to the goods sold if a warranty is provided on the basis of a written warranty card.
  6. In the case of individuals, only persons with unlimited legal capacity can be customers of the online store.
  7. The customer places the order in the following way:
    • Selecting products and adding them to the shopping cart.
    • Providing the information requested in the registration, access and delivery form.
    • Selecting the method of payment and shipping.
    • Confirming the order via the “Order with charges” button or similar.
    • Receiving the order confirmation to the e-mail address provided.
    • Order confirmation is made within two working days (excluding holidays) after receipt of the order, by electronic communication (via e-mail or telephone).

  9. The customer who places an order according to Paragraph 8 is required to read and accept the General Terms and Conditions sent by the store to the indicated e-mail address.
  10. The customer placing an order according to Paragraph 8 must provide the following information:
    • Name, size, color and quantity of products.
    • Recipient’s full name, delivery address.
    • Phone number.
    • E-mail address.
  11. The customer agrees to provide correct data.
  12. Customers can personally pick up their order at a predefined location. This requires separate contact and agreement between the contracting parties.

  2. Customers have the right to download the contents of the General Terms of Use to their device or print them out.
  3. The laws of the European Union and national laws apply to the business relationship between the seller and the consumer. If the rules applicable in the consumer’s country are more favorable to the consumer and cannot be excluded by contract, they will be applied in the context of this contract.
  4. If the customer is a consumer, any disputes arising from the General Terms of Use can be resolved out of court, such as through the European Union Online Dispute Resolution (ODR platform), which can be accessed at: http://ec.europa.eu/consumers/odr/
